This service contract governs the support process for the Trade-in Program between the Program Manager – Rashi Peripherals Private Limited (RP Tech) and Trade-in channel (Resellers), involved in the Trade-in for iPhones.
IMPORTANT: The Trade-in channels need to ensure that the points mentioned below are checked and adhered to before completing the trade-in request. Servify or Program Manager will not be responsible for any misinterpretation/miscommunication made by the Trade-in channel that may have an effect of the Trade-in value of the eligible device.
In order for customer to participate in the Trade-in Program the Trade-in channel needs to confirm if the customer is eighteen (18) years of age or older and is the rightful owner of the eligible device that he wishes to transfer to Program Manager through the Trade-in Program. Also, the Trade-in channel needs to inform the customer that Program Manager will not return an eligible device back to the customer once he/she receives the Trade-in value for the eligible device. The Device must be dispatched to the Program Manager, after completion of the trade-in.
The Trade-in channel needs to ensure that the customer owns all rights, titles and interests in any and all eligible devices that he/she transfers to Program Manager as part of the Trade-in Program and that all the eligible devices are not counterfeit or stolen and are free of any liens or encumbrances (including third-party software which may not be transferred or for which royalties are due). Any eligible devices that are found to have been fraudulently obtained will be handed over to the appropriate law enforcement authorities without notice or compensation to the customer/Trade-in channel. For all such devices, the Trade-in channel will have to return the Trade-in value back to Program Manager.
When the customer brings the eligible device to the Trade-in channel, the Trade-in value of the device will be determined or calculated once the same is assessed. The Trade-in channel should ensure that that all the parameters with regards to the assessment of the eligible devices are checked and entered in truthful & are unbiased before completing the Trade-in request. Servify or Program Manager will not be responsible for any misinterpretation made by the Trade-in channel that may have an effect on the Trade-in value of the eligible devices. Once the customer accepts the value of the eligible device as determined / calculated by Trade-in channel and agrees to transfer the ownership of the eligible device to Program Manager in accordance with the Terms & Conditions, he/she will be the given the agreed value of the Eligible Device. The trade-in device shall not be tampered with. It is the responsibility of the trade-in channel to ensure that the device is dispatched in the same condition as it was received.
The Trade-in channel must inform the customer that he/she is solely responsible for ensuring that any / all data and personal information is deleted from the eligible device prior to transferring it to the Program Manager. The Program Manager will not be responsible for any loss, safekeeping or maintenance in confidence of any data or personal information remaining on the Eligible Device once it is transferred and that the customer understands that any such personal information may be accessible to third-parties if it is not deleted. If the customer is unsure of how to clean the device of all data or personal information, he/she needs to consult the product information manual.
The Trade-in channel needs to ensure that the customer understands and agrees that this transaction is final and that by participating in the Trade-in Program, ownership of the Eligible Device is transferred irrevocably to Program Manager.
RP Tech will make payment of the trade-in value after receipt of the traded-in device.
EXCEPT AS PROVIDED IN THIS TRADE-IN PROGRAM AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVIFY OR PROGRAM MANAGER IS NOT RESPONSIBLE FOR AND ITS EMPLOYEES AND AGENTS WILL UNDER NO CIRCUMSTANCES BE LIABLE TO YOU OR ANY SUBSEQUENT OWNER FOR ANY INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO COSTS OF RECOVERING, REPROGRAMMING, OR REPRODUCING ANY PROGRAM OR DATA OR THE FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA, ANY LOSS OF BUSINESS, PROFITS, REVENUE OR ANTICIPATED SAVINGS. NOTHING IN THIS AGREEMENT SHALL EXCLUDE OR LIMIT SERVIFY OR PROGRAM MANAGER’S LIABILITY FOR (I) DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE, OR (II) FRAUD.
